This Privacy Policy explains how ESi Digital Marketing Inc., operating the Smart Rack Cards™ service, collects, uses, discloses, protects, retains, and provides access to personal information in connection with:
SmartRackCards.com; Smart Rack Cards™; Digital Tourist Kiosks™; the Digital Visitor Center Network™; Destination Deals™; Action Taps™; Destination Discovery™; business listings; sponsorship programs; QR codes and decals; newsletters; and related products and services.
In this Privacy Policy, "Smart Rack Cards," "we," "us," and "our" refer to ESi Digital Marketing Inc. and the Smart Rack Cards™ service.
This Privacy Policy should be read together with our Terms of Use and Disclaimer and AI Disclosure.
We collect and use personal information only for purposes that are reasonable and appropriate to the operation of Smart Rack Cards™ and our relationship with users, businesses, sponsors, Visitor Centres, Chambers of Commerce, tourism organizations, and other participants.
We seek to limit collection to information reasonably necessary for those purposes.
Our privacy practices are intended to comply with applicable Canadian privacy legislation, including the Personal Information Protection Act of British Columbia and, where applicable, the Personal Information Protection and Electronic Documents Act of Canada (PIPEDA).
Additional privacy rights may apply depending on where an individual resides.
ESi Digital Marketing Inc. has designated a Privacy Officer who is responsible for overseeing our privacy practices and responding to privacy questions, access requests, correction requests, and complaints.

The information we collect depends on how you interact with Smart Rack Cards™.
We may collect information that you provide directly, including your name, email address, telephone number, business or organization name, job title, username, account information, correspondence, subscription information, sponsorship information, billing-related information, and information submitted when claiming or managing a Listing.
We may collect information submitted for a Smart Rack Card™, including business descriptions, photographs, logos, links, Destination Deals™, contact details, operating information, and other content.
Some business information may constitute business contact information rather than personal information under applicable privacy legislation.
We may also collect technical information automatically when you use the Platform, such as IP address, browser type, device type, operating system, pages visited, referring pages, approximate geographic information derived from an IP address, interaction information, QR scans, Action Taps™, and similar analytics.
We do not intentionally require sensitive personal information in order to create an ordinary Smart Rack Card™ or use a Digital Tourist Kiosk™.
Please do not submit sensitive personal information unless it is reasonably necessary for a particular purpose and you have been specifically requested or authorized to provide it.
Smart Rack Cards™ may create preloaded or unclaimed Listings for businesses, attractions, Visitor Centres, Chambers of Commerce, communities, tourism organizations, and other organizations.
Information used for these Listings may be obtained from publicly available sources such as official business websites, tourism websites, public directories, government or community websites, social media pages, mapping services, and other sources reasonably believed to contain public business information.
This may include business names, business contact information, website addresses, descriptions, categories, general location information, and similar information.
The existence of a preloaded Listing does not mean that the business or organization has purchased a service from, endorsed, sponsored, or established a formal relationship with Smart Rack Cards™.
An authorized representative may contact us to request correction, updating, claiming, or, where appropriate, removal of information.
We may use information to operate, maintain, administer, secure, and improve the Smart Rack Cards™ Platform.
This includes creating and maintaining accounts and Listings; providing Smart Rack Cards™ and Digital Tourist Kiosks™; processing subscriptions and sponsorships; responding to inquiries; providing customer service; delivering transactional notices; managing Destination Deals™ and Action Taps™; analyzing Platform performance; detecting fraud or abuse; maintaining security; fulfilling legal obligations; and improving our products and services.
We may also use business information and authorized User Content to create, display, distribute, and promote Smart Rack Cards™, Destination Discovery™ materials, tourism information, newsletters, social media content, and related promotional materials as permitted by our Terms of Use.
When a Business User requests or authorizes our Concierge or content-creation services, we may use information supplied by that Business User or obtained from sources the Business User has authorized us to use.
This may include information from the Business User's website, social media accounts, photographs, descriptions, brochures, menus, promotional materials, or other identified sources.
We may use automated tools and artificial intelligence to summarize, organize, resize, translate, rewrite, format, or otherwise assist with preparing this content.
Business Users are responsible for reviewing their completed Listings and informing us of material inaccuracies.
Smart Rack Cards™ may use artificial intelligence and automated technologies in connection with Destination Discovery™, community information, Smart Rack Cards™, Concierge services, translations, research assistance, images, descriptions, video production, audio, and other content.
Information provided to us, authorized business content, and information obtained from public sources may be processed using third-party AI or technology service providers where reasonably necessary to provide these services.
We seek to avoid providing sensitive personal information to AI systems unless there is a legitimate business need and appropriate safeguards are in place.
AI-generated and AI-assisted content may contain errors, omissions, or outdated information. Our use of AI is further described in our Disclaimer and AI Disclosure.
Paid services may be processed through third-party payment processors.
Where a third-party payment provider processes a transaction directly, that provider may collect payment card, banking, billing, or other financial information under its own terms and privacy practices.
Smart Rack Cards™ may receive information such as the payer's name, billing contact information, transaction identifier, payment amount, subscription status, payment status, and other information reasonably necessary to administer the transaction.
We do not intentionally store complete payment-card numbers where payment credentials are handled directly by an external payment processor.
SmartRackCards.com may use cookies, log files, pixels, local storage, analytics technology, and similar technologies.
These technologies may be used to keep the website functioning, remember preferences, improve performance, understand visitor traffic, measure engagement, prevent fraud, and evaluate the effectiveness of Smart Rack Cards™, QR codes, Digital Tourist Kiosks™, and promotional activities.
Certain embedded or third-party services may also use their own cookies or similar technologies.
You may be able to restrict or delete cookies using your browser settings. Disabling certain cookies may affect website functionality.
Where applicable law requires consent for particular cookies or tracking technologies, we will seek that consent in the manner required by law.
When a visitor scans an official Smart Rack Cards™ QR code or interacts with a Digital Tourist Kiosk™, we may collect analytics concerning the interaction.
This may include the date and time of the scan, device or browser information, approximate location derived from technical information, pages viewed, Smart Rack Cards™ selected, and subsequent Action Taps™.
We may aggregate or de-identify analytics for reporting, planning, product improvement, tourism analysis, sponsor reporting, or business performance information.
Where analytics are provided to participating businesses, sponsors, Visitor Centres, Chambers of Commerce, or tourism organizations, we will normally seek to provide aggregate or non-identifying information unless disclosure of identifiable information has been authorized or is otherwise permitted by law.
Action Taps™ may direct visitors to websites, booking systems, ordering systems, maps, telephone services, email services, social media platforms, payment systems, or other services operated by third parties.
Once you leave Smart Rack Cards™ or interact directly with a third-party service, that third party may collect information according to its own privacy policy and terms.
Smart Rack Cards™ does not control the privacy practices of independent third parties.
We encourage users to review the privacy policies of websites and services with which they interact.
We may engage service providers to assist with services such as website hosting, database hosting, cloud storage, email delivery, payment processing, analytics, mapping, cybersecurity, customer support, software development, artificial intelligence, media creation, and communications.
These providers may receive information only to the extent reasonably necessary to perform services for us or as otherwise permitted by law.
We seek to use appropriate contractual, technical, organizational, or other measures to protect personal information handled by service providers.
ESi Digital Marketing Inc. remains responsible for personal information under its control to the extent required by applicable privacy law.
Smart Rack Cards™ may use products and services supplied by third-party technology companies.
These may include products offered by Google and Alphabet Inc., including services such as Google Maps, NotebookLM, Gemini, and related infrastructure or technologies.
We may also use other AI, cloud-computing, hosting, analytics, communications, or technology providers.
Use of a third-party technology product does not mean that Smart Rack Cards™ is owned by, affiliated with, endorsed by, or in a partnership with that technology company.
Third-party providers operate under their own privacy and security practices.
We may disclose information to service providers as described in this Privacy Policy.
We may also disclose information when reasonably necessary to process a transaction, provide a requested service, investigate fraud or misuse, protect the security of the Platform, enforce our Terms of Use, respond to a lawful request, comply with a court order or legal obligation, protect our legal rights, or protect the safety or rights of another person.
Information associated with a public Smart Rack Card™ or business Listing may be publicly displayed as part of the purpose for which it was provided.
If ESi Digital Marketing Inc. or Smart Rack Cards™ is involved in a merger, financing, acquisition, restructuring, sale of assets, or transfer of the Smart Rack Cards™ business, relevant information may be disclosed or transferred as part of that transaction, subject to applicable law.
A Sponsor does not receive unrestricted access to personal information simply because it sponsors a Digital Tourist Kiosk™, community, program, or Listing.
Some of our service providers may store or process information outside British Columbia or outside Canada, including in the United States or other jurisdictions.
When information is processed in another jurisdiction, it may be subject to the laws of that jurisdiction and may be accessible to courts, law-enforcement agencies, national-security authorities, or other government authorities in accordance with local law.
Where required, we take reasonable steps designed to ensure that service providers handling information on our behalf provide appropriate protection for that information.
You may contact our Privacy Officer if you have questions about the use of service providers outside Canada.
Smart Rack Cards™ may send newsletters, promotional messages, destination information, sponsorship information, business opportunities, and other commercial electronic communications where permitted by law.
Where consent is required, we will seek the appropriate consent.
Commercial electronic messages sent by Smart Rack Cards™ will include the identification and unsubscribe information required by applicable law.
You may unsubscribe from marketing communications using the unsubscribe method included in the communication or by contacting us.
Unsubscribing from marketing messages does not prevent us from sending necessary transactional or service communications concerning an active account, subscription, payment, security matter, or other existing business relationship where those messages are permitted by law.
We use reasonable administrative, technical, and organizational safeguards appropriate to the nature and sensitivity of the information in our control.
These measures may include access controls, passwords, secure hosting practices, software updates, restricted administrative access, backups, monitoring, and other security measures.
No internet service, computer network, database, transmission, or storage system can be guaranteed to be completely secure.
Users are responsible for protecting their own account credentials and notifying us if they suspect unauthorized access.
We retain personal information only for as long as reasonably necessary to fulfill the purposes for which it was collected, maintain appropriate business and transaction records, resolve disputes, enforce agreements, meet legal obligations, protect security, and maintain appropriate backups.
Retention periods may vary depending on the type of information and the circumstances.
When personal information is no longer reasonably required, we may securely delete, destroy, anonymize, or de-identify it, subject to legal and operational requirements.
Information may remain temporarily in backups or archival systems after deletion from active systems.
Public business information associated with an unclaimed Listing may continue to be maintained where lawful and appropriate even where separate account information has been deleted.
Subject to applicable law, an individual may request access to personal information that ESi Digital Marketing Inc. has under its control concerning that individual.
An individual may also request correction of personal information believed to be inaccurate or incomplete.

We may need to verify your identity before providing access to personal information.
Access may be limited or refused where permitted or required by law, including where disclosure would reveal another person's personal information, confidential commercial information, information protected by legal privilege, or information that cannot lawfully be disclosed.
We will respond to access and correction requests within the time required by applicable law.
Where our collection, use, or disclosure of personal information is based on consent, you may withdraw that consent subject to reasonable notice and legal, contractual, or operational restrictions.
Withdrawal of consent may affect our ability to provide certain services.
Consent cannot necessarily be withdrawn where continued collection, use, disclosure, or retention is required or permitted by law or is necessary to complete an existing legal obligation.

We will make reasonable efforts to investigate and respond to legitimate privacy complaints.
If you are not satisfied with our response, you may have the right to contact the applicable privacy regulator, including the Office of the Information and Privacy Commissioner for British Columbia or the Office of the Privacy Commissioner of Canada where that regulator has jurisdiction.
The Smart Rack Cards™ Platform is designed primarily as a tourism information and business-services platform.
We do not knowingly seek to collect sensitive personal information from children.
If we become aware that personal information concerning a child has been submitted in circumstances requiring parental or guardian consent and appropriate consent has not been obtained, we may delete or restrict that information as appropriate.
Smart Rack Cards™ is primarily a business and tourism directory.
Business names, business addresses, public business telephone numbers, business websites, categories, operating hours, and similar business information may not constitute personal information under applicable privacy laws.
However, where business information is associated with an identifiable individual and is protected by applicable privacy legislation, we will handle it in accordance with our legal obligations.
We may update this Privacy Policy as our services, technology, business practices, or legal obligations change.
The current version will display the effective date and last-updated date.
Material changes will apply prospectively.
Where applicable law requires notice or consent for a new use or disclosure of personal information, we will provide that notice or obtain that consent before the new practice takes effect.
